Top 10 Class Actions on Florida Dockets

A class action is a type of civil lawsuit wherein a number of plaintiffs (typically in the thousands) join their claims together into one single lawsuit, headed by one or several class representatives. There are a number of advantages to a class action, most notably the convenience factor for those seeking redress following catastrophic injuries. Class actions often involve consumer goods, medical products and devices or consumer fraud claims, which makes it nearly impossible for the defendant manufacturer to engage in litigation with each individual claimant. As such, class actions are available to plaintiffs suffering similar injuries, caused by a common defendant, seeking similar damages.

In Florida, a number of class actions are awaiting final resolution via settlement or jury verdict. If you have been injured by a consumer product and would like to speak with an attorney at a reputable Ft. Lauderdale class action law firm, we encourage you to contact Michael L. Feinstein, P.A. right away. Currently, the following top 10 class actions are pending in Florida's federal and state court systems:

  • Nissan North American: Filed in U.S. District Court for the Southern District of Florida, plaintiffs allege the company failed to warn consumers of known transmission problems in the 2013 and 2014 Pathfinder SUV.
  • Lexus & Toyota Motor, Corp.: In a class action lawsuit filed against Lexus and its parent corporation, plaintiffs allege that the interior designs of several Lexus models are unable to withstand the extreme heat of Florida's tropical climate, causing dashboards to melt.
  • Kia Motors: In yet another motor vehicle class action, Kia Motors is facing a complaint filed in U.S. District Court for the Central District of California alleging it failed to warn of known issues with the brake switch in its newer model Sportage design.
  • Accera, Inc.: Maker of the "Axona" shake beverage, Accera, Inc. is facing a Florida class action by several plaintiffs claiming it committed consumer fraud by asserting the drink could help reverse the effects of Alzheimer's Disease.
  • Remington Arms: The infamous gun maker is facing a class action lawsuit alleging its Model 700 Rifle Series contains a serious defect, causing to fire without a trigger pull. A similar issue occurred in the 1970's, leading to a massive recall and several settlements for injured victims.
  • The Dial Corporation: The makers of antibacterial hand soap recently faced a class action lawsuit alleging consumer fraud with regard to its Dial Complete product - specifically, that it is 1000% more effective than regular soap in killing harmful germs.
  • Subaru of America, Inc.: The Subaru corporation is facing a class action, filed primarily in New Jersey with a Florida sub-class, alleging it failed to warn consumers that a flaw in its engine design caused certain vehicles to consume excessive amounts of oil.
  • Ford Motor Company: Also filed in the Southern District of Florida, the Ford Motor Company is facing a class action lawsuit involving its Explorer model SUV's. Specifically, plaintiffs claim that problems with the exhaust system are causing dangerous carbon monoxide to leak into the interior of the vehicle.
  • Bear Naked: Filed in January, 2015, the makers of the Real Nut Energy Bars are facing a class action involving fraudulent and misleading consumer communication. More specifically, the bars featured language promising the ingredients were "all natural," however the product contains tocopherols, glycerin and lecithin.
