5 Considerations for Hiring Outside Litigation Counsel

Whether your company is facing potential exposure or the prospect of needing to file suit against a competitor, vendor or other third party, the earlier you can get outside litigation counsel involved, the better. The sooner outside litigation counsel gets up to speed on the facts, the sooner you can begin to develop a litigation (or, ideally, pre-litigation) strategy tailored to securing as favorable outcome as quickly and cost-effectively as possible.

If you are looking for an outside trial litigation attorney for a business or commercial dispute in the Fort Lauderdale area, here are five considerations to keep in mind:

1. Trial Experience

This one should be a no-brainer. You are hiring outside litigation counsel precisely because you need someone who has the background necessary to advise you on strategy and to effectively represent your company in all phases of the litigation - up to and including trial. Ideally, you want someone who has served as lead counsel in numerous trials and who has a demonstrated record of using pretrial negotiation and litigation tactics to secure favorable resolutions outside of the courtroom.

2. Local Reputation

In litigation, reputation matters. While reputation certainly will not win or lose a case, it can undoubtedly play a role in how your opposing party reacts to situations during the course of the litigation. Of course, results and reputation tend to go hand-in-hand.

3. Substantive Knowledge

While you expect to have to get outside litigation counsel up to speed on the facts, your trial counsel should already be familiar with the substantive law at play in the litigation. You do not want to have to spend the time (or money) to educate your trial counsel on the legal issues involved in your case. When inquiring about an attorney's trial experience, be sure to inquire about his or her substantive practice focuses as well.

4. Firm Resources and Capabilities

These days, some law firms are one attorney in a shared office space with a shared administrative assistant. When facing the prospect of complex litigation, don't you want something...more? The firm you choose should have the personnel, technological resources and financial wherewithal to keep pace with your needs while providing sound advice and effective representation.

5. Accessibility

In complex litigation, you often need your trial counsel to be available at a moment's notice. When circumstances change, or when your company's executives request a meeting to discuss alternative strategies, you need to be able to trust that your trial counsel will make himself or herself available as soon as possible. Simply put, you need your outside counsel to be accessible, and you need your case to be treated as a top priority.
