Business litigation underway due to alleged ADA violations

Running businesses means staying compliant with many Florida state and federal laws regarding operations. One of the federal laws that needs to be understood and complied with is the Americans with Disabilities Act. The ADA provides guidelines for how business owners and operators should accommodate the needs of patrons with disabilities, among other topics. If violations of the ADA occur, affected patrons could file lawsuits that lead to business litigation.

It was recently reported that numerous art galleries in another state are facing lawsuits that allege violations of the ADA. Apparently, the issue revolves around the galleries' websites and a lack of accessibility for visually impaired and blind individuals. One individual who is considered legally blind has filed 37 lawsuits against art, rare book and antiquities dealers for similar issues.

The problems that visually impaired and blind individuals are having with the sites include an inability to use screen-reading software because information on the websites cannot be rendered into text. A lack of "alternative text" is also a problem. Though these aspects are causing issues for individuals with visual disabilities, it is unclear what obligation businesses truly have regarding websites because the ADA was created in 1990, a time when websites were not the norm. The development of new regulations started in 2010, but the current presidential administration stopped the development in 2017.

When businesses face serious allegations that lead to lawsuits but the law is unclear about the particular issue, the cases can be immensely complex. Florida company owners will certainly want to understand their best options for handling similar predicaments that lead to business litigation.
