Business litigation over trademark infringement involves Target

Starting a small business is not an easy task. It can take years of planning and struggles to get to a point where a business can stand on its own. As a result, when a larger company infringes on a trademark or other intellectual property, the smaller business may worry about being squashed. However, business litigation may help address the matter.

Florida readers may be interested in a lawsuit involving a woman in a nearby state and retail giant Target. Target recently launched a food brand called Good & Gather, which includes various foods that the company claims is of high quality. However, the woman claims that the company has infringed upon the trademark that she has for her small business Garnish & Gather. The business apparently works to connect customers with local chefs and locally grown food.

The woman indicated that approximately 40 to 50 products overlap between her company and Target's new line. She believes that the name and logo of the food brand are also too similar to the ones she has already established and trademarked. She also indicated that the company offered her monetary support for search engine optimization, but she turned down the offer. Instead, she hopes that the lawsuit will result in Target stopping the use of her trademark and help preserve her brand.

It can be difficult to start a small business and have to come up against a much more well-known company. Still, if issues such as trademark infringement take place, business litigation may be necessary. If Florida businesses believe that their intellectual property has been stolen or they have faced similar matters, they may want to look into their legal options.
