Appeals likely after court case rules against Bayer

Though companies may try their best to handle lawsuits, the outcomes are not always in their favor. Fortunately, many Florida companies facing this type of predicament may be able to file appeals in efforts to reach a more favorable result. Of course, this process can be difficult, and it is important to have the right help.

It was recently reported that Bayer received an unfavorable judgment in a case involving a farmer and claims against the company's weed killer, dicamba. According to reports, the suit began after the farmer claimed that his peach trees were damaged due to the pesticide traveling from other farms in the area to his farm. As a result, it was unexpected for the trees to survive the contamination. The jury ruled in favor of the farmer and awarded him $265 million.

Bayer, on the other hand, did not believe that the pesticide drift caused the damage to the peach trees. Instead, they argued that the trees suffered from root fungus and adverse weather conditions. Though the outcome of the initial case was not beneficial for the company, the report stated that Bayer plans to appeal the decision.

As this case shows, court rulings could put companies on the hook for hundreds of millions of dollars. In such cases, reviewing all appeals options may be worthwhile. If Florida companies have received unfavorable judgments and would like to determine whether appealing is an option, they may wish to discuss the possibility with their legal counsel. The process of appealing a case is different from initial litigation, and having legal professionals who understand the process is wise.
