Meet award-winning attorney Jason Ari Smith. Jason specializes in handling complex civil litigation cases, with a strong emphasis on business and real estate law. His business litigation expertise includes representing a diverse range of clients such as shareholders, officers, directors, LLC members, managers, business partners, and other stakeholders. Jason has worked on cases involving shareholder rights, restrictive covenants like non-compete and confidentiality agreements, commercial debt collection, and issues surrounding consumer protection, unfair competition, trade secrets, racketeering, securities fraud, and copyright matters. He is also well-versed in navigating disputes related to contracts and business torts.

In the practice of real estate litigation, Jason has extensive experience advocating for clients in disputes involving construction projects, including owners, developers, design professionals, contractors, and suppliers. He has represented clients in commercial and residential landlord-tenant disagreements, foreclosure actions, and conflicts regarding the enforceability of purchase-sale agreements. Jason also handles cases involving broker commission disputes, disclosure requirements, ADA compliance, governance issues within condominium and homeowners associations, title disputes, mortgage fraud, and real estate-related insurance claims. His practice further extends to addressing architectural and structural compliance under the Americans with Disabilities Act (ADA) and other real estate contract and tort issues.

Beyond business and real estate, Jason represents clients in other civil litigation areas, such as employment disputes involving allegations of discrimination, wrongful termination, and wage/hour claims. He also has experience in trust and estate matters, including cases concerning trustee duties, fraud, and undue influence. Additionally, Jason handles professional liability disputes, representing clients in malpractice claims and fiduciary duty breaches involving lawyers, accountants, real estate brokers, insurance professionals, architects, engineers, and healthcare providers.

Jason holds the prestigious Certified Fraud Examiner (CFE) credential from the Association of Certified Fraud Examiners (ACFE), the largest global organization dedicated to anti-fraud education and training. This credential underscores his dedication to combating fraud and white-collar crime and aiding organizations in fraud prevention and detection.

Born in Abington, Pennsylvania, Jason pursued his undergraduate studies at Tulane University, earning a merit-based Founders Scholarship. He graduated cum laude in 2004 with a Bachelor of Science in Business Management and Legal Studies in Business. Jason continued his education at the University of Miami School of Law, where he earned his Juris Doctor cum laude in 2007. During law school, he excelled in moot court competitions, serving as Vice President of the Charles C. Papy, Jr. Moot Court Board and winning the Advanced Moot Court Competition in 2005. He was also a finalist in the 2006 American Bar Association Regional Negotiation Competition.

Active in his community, Jason serves on the board of the B’nai B’rith Justice Unit #5207, participates in the Broward County Bar Association, and remains connected with the Tulane Alumni Club of South Florida.

Michael Saved the Day! Attorney Feinstein literally saved me from losing a large $$$ deposit amount that I paid on a new home. My first appointment with him was amazing. He was courteous and professional. He listened to my problem and quickly went to the computer and began to find information related to it and started the first steps in solving it. I was impressed with his knowledge of using computers and of Real Estate Contracts and Law. Mike was recommended to me by my loan officer last minute, on the day of the closing and the seller refuse to sign claiming a ‘mistake’ in the selling contract and wanted me to pay for it with the excuse that closing cost credit stated in contract was not intended for me.
